Wedding Contract
Xtraordinary Photography – Terms & Conditions of Contract
This Contract is entered into between the Clients (whose names appear on the agreement) and Chris Ord, trading as Xtraordinary Photography, hereinafter referred to as "the Photographer(s)." Where applicable under clause 6b), this term also includes any other photographer(s) appointed by Chris Ord.
If a third party is paying on behalf of the Clients, the contractual relationship remains solely with the Clients. This Contract is binding and may not be varied unless expressly agreed in writing by the Photographer(s).
1. Copyright
All images captured under this agreement are protected under the Copyright, Designs and Patents Act 1988. The copyright remains with the Photographer(s). Reproduction, distribution, or copying of images by any method—whether physical, electronic, or digital—is strictly prohibited without prior written permission or a royalty-free license granted by the Photographer(s) or their agents.
2. Usage and Display
The Clients grant the Photographer(s) the right to use any images for business promotion, including but not limited to advertising, websites, social media, exhibitions, competitions, or editorial features, provided such use is lawful and does not cause harm to the Clients’ reputation. Images in password-protected galleries are generally not accessible to the public, though absolute prevention of access cannot be guaranteed.
3. Photographic Coverage & Artistic Discretion
a) The Photographer(s) are granted full artistic discretion regarding locations, poses, and image selection. While every effort will be made to accommodate Client preferences, the Photographer(s)' creative judgment is final.
b) Venue restrictions, such as those imposed by officiants at churches or other locations, may limit photographic opportunities. The Photographer(s) are not responsible for any resulting limitations in coverage.
c) The Photographer(s) are not liable for missed photographs due to delays, absence of key individuals, or unforeseen conditions on the day.
d) Any Client-requested changes to the agreed booking (e.g. date, time, venue) are subject to the Photographer(s)’ availability and discretion. Inability to accommodate changes will not result in compensation.
e) Coverage typically includes bridal preparations through to the first dance unless otherwise specified in the Wedding Arrangements document.
f) Engagement sessions should be scheduled between 12 to 4 weeks prior to the wedding to allow for timely image processing.
4. Image Quality & Reproduction
a) The Photographer(s) aim to provide a pleasing colour balance but cannot guarantee exact colour reproduction due to material or dye limitations, particularly in synthetic fabrics.
b) Variations in lighting conditions may result in inconsistent colours throughout a set. Print colours may vary between sizes and batches.
c) Monitor calibration differences mean digital images may not appear consistent across devices and will differ from printed results.
d) Where digital files are provided, compatibility is ensured with Windows 7 Home Edition as the default system. Operation on other systems is not guaranteed.
e) DVD media is tested for quality, but may not play on all DVD players—especially older models.
f) Discs are checked prior to delivery. Clients are responsible for checking for damage in transit. The Photographer(s) are not liable for damage to the Client's equipment caused by faulty media.
g) All print and presentation sizes are approximate and may vary at the Photographer(s)’ discretion.
5. Payments & Pricing
a) A non-refundable booking fee of £500 is required to secure the Photographer(s) for the event date. The remaining balance is due no later than 6 weeks prior to the wedding.
b) Album upgrades must be paid in full at the time of order. Package prices are guaranteed for 12 months post-wedding and may increase thereafter. Archived digital files (beyond 2 years) may incur a retrieval fee.
c) All reorders are subject to current pricing and may be subject to an archive search fee after 2 years.
d) Travel exceeding 50 miles from the Photographer(s)’ base may incur a charge of £0.40 per mile. Overnight accommodation may be required for distant weddings.
6. Cancellations & Postponements
a) In the unlikely event of cancellation or complete photographic failure by the Photographer(s), liability is limited to a full refund of all fees paid, including the booking fee. Re-shoots may be offered where feasible, but no additional compensation will be due.
b) The Photographer(s) will attempt to find a replacement photographer in cases of unforeseen unavailability. However, replacement cannot be guaranteed.
c) Client cancellations are subject to the following fees:
Full refund of the booking fee if cancelled within 14 days of booking.
Booking fee forfeited after 14 days.
75% of the package fee payable if cancelled within 2 months of the wedding.
100% of the package fee payable if cancelled within 1 month of the wedding.
Where the date is rebooked with another client at the same value, the Client will only forfeit the non-refundable booking fee, and any cancellation fees already paid will be refunded.
d) Postponements are subject to the Photographer(s)’ availability and discretion. Fees paid (excluding the booking fee) may be transferred to the new date.
e) Clients must promptly notify the Photographer(s) of any changes to contact information, venue, schedule, or other relevant details.

By signing this agreement or proceeding with a booking, the Clients confirm that they have read, understood, and agreed to the above terms.
